Tina Orwall (D-Des Moines), aims to reduce the retraumatization of survivors in the courtroom by allowing courts to appoint other people to cross-examine them in cases where defendants have chosen to represent themselves.<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cNo one should be subjected to the trauma and fear of being questioned by their abusers as they seek justice for what happened to them,\u201d Orwall said. \u201cThis bill addresses a critical gap in our legal system by putting in place a necessary safeguard that will protect survivors from being further traumatized\u00a0in the courtroom.\u201d\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The U.S. Supreme Court has held that people accused of crimes may choose to\u00a0proceed\u00a0pro se, which waives their federal and state constitutional right to representation by legal counsel in favor of self-representation in the courtroom. However, these proceedings can be retraumatizing for survivors of sexual and domestic violence because the pro se defendant can question them directly at trial or during preparation for it.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cHearing these voices gives us a better understanding of the failures that lead to these horrific situations,\u201d said Rep.\u00a0Chris\u00a0Stearns (D-Auburn),\u00a0sponsor of the\u00a0<\/span><a href=\"https:\/\/app.leg.wa.gov\/billsummary\/?BillNumber=2493&amp;Chamber=House&amp;Year=2025\"><span data-contrast=\"none\">companion bill<\/span><\/a><span data-contrast=\"auto\">\u00a0in the House of Representatives. \u201cBy promoting victim-centered and trauma-informed responses,\u00a0we aren\u2019t just strengthening our criminal justice system, we\u2019re strengthening our society.\u201d<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Abigail Echo-Hawk\u00a0(Pawnee),\u00a0executive vice president of Seattle Indian Health Board and director of its research division, Urban Indian Health Institute, testified in support of the bill during its public hearing\u00a0Jan. 26. Echo-Hawk described witnessing a pro se defendant, who was ultimately\u00a0<\/span><a href=\"https:\/\/www.kuow.org\/stories\/man-who-held-himself-out-as-native-american-activist-sentenced-to-46-years-for-serial-rapes\"><span data-contrast=\"none\">convicted and sentenced to 46 years<\/span><\/a><span data-contrast=\"auto\">\u00a0in prison for drugging and raping multiple women,\u00a0retraumatize survivors by cross-examining them directly for several days.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cThe pursuit of justice should never be a second act of victimization,\u201d Echo-Hawk\u00a0said.\u00a0\u201cThe legal system is being weaponized against victims of sexual violence, compounding trauma. SB 6017 preserves a defendant\u2019s rights while balancing the rights of victims who endure preventable trauma in cross-examination by their accused perpetrator.\u201d<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The bill also\u00a0provides survivors of female genital mutilation (FGM) certain rights under the\u00a0<\/span><a href=\"https:\/\/app.leg.wa.gov\/rcw\/default.aspx?cite=70.125&amp;full=true\"><span data-contrast=\"none\">Victims of Sexual Assault Act<\/span><\/a><span data-contrast=\"auto\">, also known as the Sexual Assault Survivor Bill of Rights. In Washington, about\u00a0<\/span><a href=\"https:\/\/doh.wa.gov\/you-and-your-family\/injury-and-violence-prevention\/sexual-and-domestic-violence\/female-genital-mutilation-or-cutting\"><span data-contrast=\"none\">25,000 women and girls<\/span><\/a><span data-contrast=\"auto\">\u00a0are living with or at risk of experiencing FGM, making\u00a0Washington\u00a0one of the top\u00a010\u00a0states\u00a0with the highest at-risk populations in the country.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The bill proposes changing the term \u201csexual assault survivor\u201d to \u201csexual violence survivor\u201d in the Victims of Sexual Assault Act to extend FGM survivors the same statutory rights as sexual violence survivors.\u00a0This includes the right\u00a0for survivors\u00a0to be informed\u00a0about their\u00a0potential eligibility to receive\u00a0benefits\u00a0through\u00a0the Crime Victim Compensation Program, to be informed about the status of the investigation and related prosecution,\u00a0to receive interpretation services, and more.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Absa Samba, a founding member of the Washington Coalition to End FGM\/C, said in testimony that the bill is an opportunity to give FGM survivors equal access to resources and services as other survivors of sexual and gender-based violence.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cFGM is recognized internationally as a form of gender-based violence and sexual violence, and yet,\u00a0there are gaps between this understanding and services and resource allocations for survivors in our state,\u201d Samba said.\u00a0\u201cAs a survivor who also works on this issue, I cannot tell you where to go to get services when it is needed or to get the support for survivors in our state. That is because it\u00a0doesn&#8217;t\u00a0exist.\u201d<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The bill also would\u00a0align state law for minors consenting to forensic exams, ensuring survivors can get\u00a0timely\u00a0access to the care and support they need.\u00a0Under\u00a0current\u00a0state law, minors who are 13 years or older may consent to sexual assault forensic\u00a0exams, and the bill would grant those same consent rights in<\/span><b><span data-contrast=\"auto\">\u00a0<\/span><\/b><span data-contrast=\"auto\">situations of domestic violence involving nonfatal strangulation.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The bill would also extend the Sexual Assault Forensic Examination (SAFE) Best Practices Advisory Group until 2028, as well as\u00a0shift\u00a0its purpose to\u00a0recommending actionable, trauma-informed,\u00a0survivor-centered policies related to preventing and addressing\u00a0all forms of\u00a0sexual violence.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Lauren Vlas, a senior policy analyst for the Washington State Attorney General\u2019s Office, said in testimony that that office supports reauthorizing and redesignating the SAFE Advisory Group, especially because its recommendations have led to meaningful legislative action.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cThe Attorney General&#8217;s Office is in full support of continuing the SAFE Advisory Group. This group achieves results for victims and survivors. You\u00a0[the Legislature]\u00a0have acted on over\u00a040 of the advisory group&#8217;s recommendations, resulting in\u00a0eliminating\u00a0the backlog of over 10,000 previously untested sexual assault kits, providing trauma-informed training for investigators, enacting a survivor&#8217;s bill of rights, and much more,\u201d Vlas said. \u201cDespite these accomplishments, there&#8217;s a lot more work to do to ensure that victims have equitable and consistent access to sexual\u00a0assault exams and the support services they need.\u201d<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The bill\u00a0now heads to the Senate Ways &amp; Committee for further consideration.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>OLYMPIA \u2014\u00a0A bill to increase support for survivors of sexual and\u00a0domestic\u00a0violence\u00a0has advanced\u00a0out of the Senate Law &amp; Justice Committee.\u00a0 Senate Bill 6017, sponsored by Sen.
