Pederson legislation that removes unconstitutional death penalty statute from state law<\/strong><\/h2>\n<h3><em>The legislation also removes multiple statutes from Washington law identified by the Chief Justice as unconstitutional<\/em><\/h3>\n<p><strong>OLYMPIA \u2014<\/strong>\u00a0Gov. The legislation, requested by Attorney General Bob Ferguson and sponsored by Sen. Jamie Pedersen, D-Seattle, repeals a number of unconstitutional state laws, including Washington\u2019s invalid death penalty statute.<\/p>\n<p>The legislation removes numerous invalid and unconstitutional statutes that remain on the books, based on an analysis done by the Washington Supreme Court. In addition to the death penalty, those statutes include laws allowing judges to order people sterilized and requirements that public employees sign anti-communist pledges. Rep. Tina Orwall, D-Des Moines, sponsored the companion bill in the House.<\/p>\n<p>Ferguson has proposed legislation to remove Washington\u2019s death penalty from state law every session\u00a0<a href=\"https:\/\/gcc02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fatg.us10.list-manage.com%2Ftrack%2Fclick%3Fu%3D28a64d02479d9d79402df2b20%26id%3D8979b55490%26e%3D82a5c56fb6&amp;data=05%7C01%7CLilia.Nieto%40leg.wa.gov%7C6651998814a642ca369708db41cbf90a%7C848b0e6c94894d83b31e4fde99732b09%7C0%7C0%7C638176116567010351%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&amp;sdata=RMAwUaXMNFuieMmVulVdfZyeTdPzsPvtJtoY2u8ycG4%3D&amp;reserved=0\">since 2017<\/a>. In 2018, the Washington Supreme Court found the state\u2019s method of applying the death penalty unconstitutional as a result of its arbitrary and racially biased application.<\/p>\n<p>\u201cThe Washington State Supreme Court ruled that Washington\u2019s death penalty is invalid because it\u2019s applied in an arbitrary and racially biased manner,\u201d Ferguson said. \u201cOn Friday the Legislature took the important and appropriate step of repealing the death penalty from our state statutes once and for all. Thank you to Senator Pedersen for his leadership.\u201d<\/p>\n<p>\u201cRemoving the death penalty and other laws struck down by the courts from our statute books both helps regular people understand what the law is and also makes a profound statement of our values,\u201d Pedersen said.<\/p>\n<p>The Washington Constitution requires the state Supreme Court to advise the governor of any \u201cdefects and omissions in the laws\u201d judges have determined to exist as a result of legal challenges. In a recent \u201cdefects &amp; omissions\u201d report, Chief Justice Steven Gonzalez listed 30 statutes that are unconstitutional and need to be stricken from the books, including the state\u2019s death penalty statute.<\/p>\n<p>On Oct. 11, 2018, the Washington Supreme Court ruled that Washington\u2019s use of the death penalty was \u201cracially biased,\u201d \u201carbitrary,\u201d and \u201clacks \u2018fundamental fairness.\u2019 \u201d A study submitted to the court showed black defendants were four times as likely as white defendants to be sentenced to death. The court unanimously found that Washington\u2019s use of the death penalty is unconstitutional.<\/p>\n<p>As a result, the sentences of everyone on death row at the time in Washington state were converted to life without the possibility of parole.<\/p>\n<p>In addition to the state\u2019s invalid death penalty statute, SB 5087 also removes other unconstitutional laws, including, for example:<\/p>\n<ul>\n<li><strong>Forced sterilization.<\/strong>\u00a0RCW 9.92.100 allows a judge to order certain people sterilized. This is unconscionable and at least questionable under\u00a0<em>Skinner v. Oklahoma<\/em>.<\/li>\n<li><strong>Loyalty oaths.<\/strong>\u00a0RCW 9.81.070 required public employees to sign loyalty oaths attesting that they are not communists and do not belong to subversive organizations. The United States Supreme Court ruled this unconstitutional in\u00a0<em>Baggett v. Bullitt<\/em>.<\/li>\n<\/ul>\n<p><strong>Disclosure of private financial records.<\/strong>\u00a0RCW 21.20.380 authorized administrative subpoenas of customer banking records from financial institutions without notice to the customer. The court ruled this violates Article I, Section 7 of the state constitution in\u00a0<em>State v.
