[<a href=\"https:\/\/www.tvw.org\/watch\/?clientID=9375922947&amp;eventID=2021031095&amp;startStreamAt=2151&amp;stopStreamAt=2709&amp;autoStartStream=true\">TVW Link<\/a>]<\/p>\n<p><a href=\"https:\/\/app.leg.wa.gov\/billsummary?BillNumber=5160&amp;Year=2021&amp;Initiative=false\">Senate Bill 5160<\/a>, sponsored by <a href=\"https:\/\/senatedemocrats.wa.gov\/kudererarchive\/\">Sen. Patty Kuderer<\/a> (D-Bellevue), aims to significantly reduce the number of immediate evictions that are expected if the governor\u2019s moratorium is lifted without legislative action. The current eviction moratorium is scheduled to expire on March 31.<\/p>\n<blockquote><p>\u201cThe ultimate goals of this policy\u2026are twofold: they are to keep tenants housed and to help landlords pay their bills,\u201d said Kuderer.<\/p><\/blockquote>\n<audio class=\"wp-audio-shortcode\" id=\"audio-2706-1\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"https:\/\/senatedemocrats.wa.gov\/kudererarchive\/wp-content\/uploads\/sites\/46\/2021\/03\/Kuderer-Eviction-Floor-Quote-1.mp3?_=1\" \/><a href=\"https:\/\/senatedemocrats.wa.gov\/kudererarchive\/wp-content\/uploads\/sites\/46\/2021\/03\/Kuderer-Eviction-Floor-Quote-1.mp3\">https:\/\/senatedemocrats.wa.gov\/kudererarchive\/wp-content\/uploads\/sites\/46\/2021\/03\/Kuderer-Eviction-Floor-Quote-1.mp3<\/a><\/audio>\n<p>Included in SB 5160 are several new tenant protections related to the current public health emergency, including:<\/p>\n<ul>\n<li>Prohibiting housing decisions that affect a tenant\u2019s right or ability to occupy a rental dwelling from taking into account a tenant\u2019s nonpayment of rent that accrued during the COVID-19 pandemic,<\/li>\n<li>Prohibiting landlords from imposing late fees or other charges for nonpayment of rent during the public health emergency, and<\/li>\n<li>Prohibiting landlords from denying or discouraging rental applications based on medical history. This provision is in response to some landlords\u2019 rejecting rental applications on the basis of the applicant having contracted or been exposed to COVID-19.<\/li>\n<\/ul>\n<p>To help struggling landlords, SB 5160 would allow them to apply directly to certain rental assistance programs. The bill also expands use of the <a href=\"https:\/\/www.commerce.wa.gov\/serving-communities\/homelessness\/landlord-fund-programs\/landlord-mitigation-program\/\">Landlord Mitigation Program<\/a> to reimburse claims for unpaid rent up to $5,000 to recover rental arrears accrued during the public health emergency when certain tenants vacate or abandon tenancy and default on a repayment plan.<\/p>\n<p>The bill also expands the <a href=\"https:\/\/www.courts.wa.gov\/newsinfo\/index.cfm?fa=newsinfo.EvictionResolutionProgram\">Eviction Resolution Pilot Program<\/a> statewide on a two-year basis.<\/p>\n<p>Other provisions in the bill include:<\/p>\n<ul>\n<li>A requirement that landlords offer a repayment plan for missed rent during the current public health emergency before seeking an eviction.<\/li>\n<li>Expanded use of dispute resolution centers, which can be used to successfully resolve disputes between landlords and tenants before they go to court.<\/li>\n<li>A new right to counsel to help indigent tenants navigate the legal process.<\/li>\n<\/ul>\n<blockquote><p>\u201cWhen we save someone from falling into homelessness\u2026we actually save the taxpayers a lot of money,\u201d said Kuderer. \u201cAnd so we get a really good bang for the buck with this investment.\u201d<\/p><\/blockquote>\n<audio class=\"wp-audio-shortcode\" id=\"audio-2706-2\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"https:\/\/senatedemocrats.wa.gov\/kudererarchive\/wp-content\/uploads\/sites\/46\/2021\/03\/Kuderer-Eviction-Floor-Quote-2.mp3?_=2\" \/><a href=\"https:\/\/senatedemocrats.wa.gov\/kudererarchive\/wp-content\/uploads\/sites\/46\/2021\/03\/Kuderer-Eviction-Floor-Quote-2.mp3\">https:\/\/senatedemocrats.wa.gov\/kudererarchive\/wp-content\/uploads\/sites\/46\/2021\/03\/Kuderer-Eviction-Floor-Quote-2.mp3<\/a><\/audio>\n<p>Passage of SB 5160 by the Senate comes after $110 million of federal CARES Act funds were appropriated for the <a href=\"https:\/\/www.commerce.wa.gov\/serving-communities\/homelessness\/eviction-rent-assistance-program\/\">Eviction Rent Assistance Program<\/a>. The Legislature has also appropriated $43.5 million from state disaster relief funds, and the Biden Administration\u2019s COVID relief package currently being debated contains another $510 million of flexible federal and state dollars that Washington will receive to help struggling renters and landlords.<\/p>\n<p>HB 1368 also included $2 million for lower-income small landlords to address rental and utility arrears through the <a href=\"https:\/\/www.commerce.wa.gov\/serving-communities\/homelessness\/landlord-fund-programs\/#:~:text=Washington%20State%20Limited%20Landlord%20Relief,were%20the%20result%20of%20a\">Limited Landlord Relief Program<\/a>.<\/p>\n<p>SB 5160 will now go to the House of Representatives for consideration. It has until April 11 to be approved by the House to be eligible to become law this year.<\/p>\n<p>The 2021 legislative session is scheduled to adjourn on April 25.<\/p>\n<p><em>***Correction: An earlier version of this release stated the $110 million for the ERAP was appropriated by the Legislature.
