Annette Cleveland\n(D-Vancouver), who sponsored companion legislation to the House bill that\npassed today in the Senate. \u201cThe Trump administration\u2019s efforts to rescind the\nact this week make passage of this legislation more important and urgent than\never.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a filing Monday to the 5<sup>th<\/sup>\nCircuit Court of Appeals in New Orleans, the U.S. Justice Department said it\nagrees with an earlier Texas court ruling that the Affordable Care Act is\nunconstitutional. That ruling is under appeal. If the act were rescinded, a\nwide range of popular consumer protections would be eliminated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWashingtonians should be reassured that\nour top priority at the state level this year has been to protect everyone\u2019s\naccess to full and affordable health care coverage,\u201d said Cleveland, who chairs\nthe Senate Health &amp; Long Term Care Committee. \u201cToday\u2019s legislation will\nprotect Washingtonians from losing the health care they and their families\nneed, regardless of the actions of the White House or the courts.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/app.leg.wa.gov\/billsummary?BillNumber=1870&amp;Chamber=House&amp;Year=2019\">House\nBill 1870<\/a> requires that any health\ncare plan sold in Washington state provide numerous consumer protections,\nincluding: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Strict annual limits on out-of-pocket costs to consumers, such as\ncopays and deductibles;<\/li><li>Coverage cannot be denied based on a consumer\u2019s existing medical\ncondition;<\/li><li>Guarantees that patients can\u2019t be dropped from coverage, except in\ncases of fraud;<\/li><li>Prevents patients from being charged more based on their health\nstatus; <\/li><li>Providers cannot cap the maximum cost of coverage or benefits in a\npatient\u2019s lifetime; and<\/li><li>Provides patients with a standardized summary of benefits so they\ncan more clearly understand what is covered. <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The bill also codifies requirements for:\noutpatient care; emergency services; hospitalization; pregnancy, maternity and\nnewborn care; mental health and substance abuse treatment; prescription drugs;\nrehabilitative services and equipment; laboratory services; p<a href=\"https:\/\/www.healthcare.gov\/coverage\/preventive-care-benefits\/\">reventive and\nwellness services<\/a> and chronic disease management; reproductive care;\nbreastfeeding; and pediatric services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPeople are scared, and this week\u2019s\nactions by the White House have confirmed their worst fears. People are worried\nthey might not be able to get the care they need and deserve, or that a single\ncatastrophic illness could wipe out their savings and cost them their home,\u201d\nCleveland said. \u201cNo one should have to decide between medical care and putting\nfood on the table, or sacrifice everything they own just to get medical care.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although it had already passed the\nHouse, HB 1870 was amended by the Senate and must now go back to the House for\npassage in its amended form before it can be signed into law by Gov. Inslee.\nOne amendment by the Senate added an emergency clause, meaning the bill would\ntake effect immediately upon the governor\u2019s signature instead of the standard\n90 days after the final day of the legislative session.
